bymse.design presents the work and the products of By MSE. By using the site, the assistant or By MSE 360 Studio you accept these terms.

CONTENT AND RIGHTS

• The texts, the design and the code of this site, and the By MSE name and mark, belong to By MSE unless stated otherwise. They may not be copied or redistributed without permission.
• The 360° tours shown under Projects are opened from their own published addresses. The designs and the content of those projects belong to their owners; where a tour names its rights holder, the site repeats it.
• The typefaces offered in Settings are open-licence families, used under their own licences (SIL Open Font License or Apache License). The licence texts are in LICENSES.txt.

NAMES OF OTHER COMPANIES

3ds Max and AutoCAD are trademarks of Autodesk; Photoshop, Illustrator, After Effects and Premiere Pro are trademarks of Adobe; Unreal Engine and Fab are trademarks of Epic Games; Blender is a trademark of the Blender Foundation. Other names belong to their owners. They are mentioned only to say what the By MSE products work with; By MSE is not affiliated with, or endorsed by, these companies.

PRODUCTS IN DEVELOPMENT

By MSE Tool and the desktop apps, the Unreal Engine products (Project One, Project One Source, ByMSE Road, ByMSE Compass, the pedestrian system, ByMSE Interact) and By MSE Digital Art are in development and have no date. What is written about them describes work in progress and is not an offer for sale. When a product goes on sale, its own purchase terms and licence, shown at the time of purchase, apply.

BY MSE 360 STUDIO

The Studio lets you make and share virtual tours from renders or 360° photos. It is open for approved accounts: you send an early-access request (on the Studio's early-access page or, once signed in, on its waiting screen) and a person approves it by hand, or you enter an access code that By MSE has sent you. An access code works once and is meant for the person it was sent to. Accounts are for people aged 18 or over. The first project is free and no card is needed. On the free plan an account has its first project only, and this is not renewed: a deleted project counts too. In the life of the account at most 15 panoramas can be uploaded (replacing a picture is an upload too); a tour has at most 15 rooms, the space is 500 MB, and tours show a small By MSE mark. Deleting an account and opening it again within 24 months does not reset these. When the early-access trial is open, an approved early-access request gives a free 7-day Pro trial once per e-mail address and browser (forms of an address with dots or a + tag count as the same address); no card is asked. When it ends, the account moves to the Free plan with the limits above; nothing is charged and nothing is deleted. Paid plans are not open; their terms, refunds and the right of withdrawal are added here when they open.

YOUR ACCOUNT AND YOUR CONTENT

• Only you use your account; one person opens one account, and only if they are 18 or over. A second account opened from the same browser is suspended. Some other signals suspend or ban an account automatically (they are written on the privacy page), and the administrator can suspend or ban an account by hand; a new account cannot be opened with the address or device of a banned account.
• What you upload is yours. You give By MSE only the permission needed to store and show your tour. A tour is shown on this site as an example only with your written permission.
• You may not upload content that belongs to someone else without permission, is illegal, contains child sexual abuse, spreads hate or violence, or relies on deception or unwanted advertising. If such content is reported or seen, the tour is closed and the account may be suspended.
• A single report of child sexual abuse takes the tour offline at once (its page and data stop answering and the cache is cleared); its files are then moved, within hours, to a place no address points to, and kept, not published, until a person has reviewed the report, and the owner's account is suspended for review. If the review confirms the report, the files are deleted and the case is reported to the competent authorities (in Türkiye the İnternet Bilgi İhbar Merkezi, ihbarweb.org.tr); if the report proves wrong, the tour comes back online and the account is reopened. A match reported by Cloudflare's CSAM scanning makes us delete the files as soon as it is received, suspends the owner's account for review, and the case is reported to the competent authorities in the same way. In every case a record for the authorities is kept as the privacy page says.
• If your account is suspended or banned, you are told why by e-mail and at sign-in. If you think it is a mistake, write to destek@bymse.design; a person looks at it and, if you are right, the suspension or ban is lifted without delay.

THE ASSISTANT

The assistant writes its answers automatically from the site's own texts. Its answers are information only: they are not an offer, a promise, a price or a date, and they can be wrong. For anything you want to rely on, write to destek@bymse.design.

THE SURVEY AND MESSAGES

Answering the survey and leaving a message are voluntary. Do not put anything in them you do not want By MSE to read.

VISUALISATION WORK

The visualisations, tours, films and interactive scenes of By MSE show a design as it may look. They are not a licensed architectural or engineering service and do not replace the drawings, calculations or approvals of a licensed professional.

SUPPORT

Support given through the Buy Me a Coffee link is voluntary and is not the purchase of a product or service. The payment is taken and processed by Buy Me a Coffee under its own terms.

OTHER SERVICES

Tours are served by Panoee; links lead to Instagram, YouTube, LinkedIn, ArtStation and Pinterest. Those services have their own terms, and this site is not responsible for their content.

CONTINUITY AND NO WARRANTY

The site and the Studio are offered as they are. Care is taken to keep them correct and available, but no warranty is given that they will be free of errors or interruptions; interruptions with causes outside By MSE's control (failures of internet and infrastructure providers, natural disasters and the like) are not By MSE's responsibility. When a free service's daily limit is reached (for example the assistant's or the daily e-mail limit), you may be asked to try again later. To the extent the law allows, no liability is accepted for loss arising from their use.

ACCURACY

The site, the Studio and everything written on them may contain technical, typographical or other errors, and may be incomplete or out of date. By MSE does not warrant that they are accurate, complete or current, and may change them at any time without notice. If you spot a mistake, write to destek@bymse.design so it can be fixed.

CHANGES

When these terms change, the date at the top changes; account holders are told about an important change by e-mail.

LAW

These terms are governed by the laws of the Republic of Türkiye.
